TERMS AND CONDITIONS

The Shinjuku Japanese Language Institute (hereby known as "Our School") maintains this website and its on-demand courses for use by its customers, partners, students, employers and other site users (hereby known as "Users") in accordance with the following terms. These terms and conditions apply to courses purchased through our on-demand program available at https://ondemand.sng.ac.jp/, (hereby known as "Our on-demand website")

Please read these conditions carefully before using our on-demand website and purchasing courses listed on it. Using our on-demand website implies acceptance of these "Terms and conditions" and constitutes a binding agreement between you and Shinjuku Japanese Language Institute. If you do not accept these terms, please do not use or purchase courses on our on-demand website.

1. Refunds and Cancellations

Courses offered on our on-demand website are non-refundable. Once a course is purchased, no refund will be provided. No exceptions. 

2. Course Fees and Payment Details

The price of each course on our on-demand website  is 89,100 yen, including tax. This price includes 81,000 yen for course fees plus a 10% tax (8,100 yen), totaling 89,100 Japanese yen. Please note that currency exchange rates are subject to change without notice, as they are influenced by ongoing fluctuations in global financial markets, including changes in economic conditions, interest rates, and geopolitical events. 

3. Course Access and Completion Conditions

Upon purchase, students will be granted access to the course for a duration of six (6) months from the date of enrollment. The course content, including lessons and materials, will be released according to a predetermined drop schedule or time-release schedule, rather than being made available in its entirety at the time of purchase.

All course content will be fully accessible within forty-nine (49) days of the student’s enrollment. The release of lessons will follow a structured timeline, meaning that certain lessons or sections will only become available after specific intervals from the date of purchase.

The term “on-demand” as used in these terms and on our website refers strictly to the availability of course content that has already been released per the aforementioned schedule. It does not imply that students will have immediate access to all course content upon enrollment. By enrolling in this course, the student expressly acknowledges and agrees to this structured release schedule and waives any claim or demand for immediate access to course content that has not yet been made available according to the schedule.

To be eligible to receive a certificate of completion, the student must fulfill all course requirements and successfully complete all sections as instructed. Additionally, a minimum period of 49 days must elapse from the date of purchase before a student is eligible to complete the course and receive their certificate.

By accepting these Terms and Conditions, the student confirms their understanding of and agreement to the scheduled release of course content as outlined above.

4. Confidentiality Clause

The IT media and documents provided by the User to Shinjuku Japanese Language Institute remain the property of the User. The data contained within these media and documents is strictly protected by professional secrecy, and this confidentiality applies to all data Shinjuku Japanese Language Institute becomes aware of during the execution of this contract.

Shinjuku Japanese Language Institute commits to taking all necessary precautions to ensure the security of the information, specifically to prevent any distortion, damage, or unauthorized access to this information.

Shinjuku Japanese Language Institute therefore commits to respecting the following obligations and ensuring its personnel adhere to them: not to make any copies of the documents and information provided, except for those necessary to perform the service specified in the contract or order. With the prior consent of the data owner, Shinjuku Japanese Language Institute commits to not using the documents and processed information for purposes other than those specified in the contract or order; not to disclose these documents or information to any other individuals, whether private or public, physical or legal entities; to take all measures to prevent any misuse or fraudulent use of computer files during the contract’s execution; to take all security measures, especially physical measures, to ensure the preservation and integrity of the processed documents and information for the duration of this contract; to only return the information in aggregated form to preserve the anonymity of individuals at the end of the contract or order; and to destroy all manual or computerized files storing entered information.

5. Trademark and Copyright

The Shinjuku Japanese Language Institute and its various associated trademarks and services are owned by our school and the Ezoe Educational Foundation. Our partners must ensure they comply with all relevant copyright and trademark regulations. Any unauthorized use of content from our school may infringe upon copyright, trademark, and other legal protections.

The course content is provided to the User as a rental and remains the property of Shinjuku Japanese Language Institute. Users are prohibited from sharing or redistributing this content to unauthorized persons or third parties. Publishing or sharing our school's course content in any form, including downloaded digital or printed copies, may result in legal action to the fullest extent permitted by applicable laws, both in Japan and in the User's country.

6. Use of Course Materials

Our school provides Users with various learning materials, such as slide shows, videos, PDFs, quizzes, questions, text information, and other resources within courses offered through our on-demand website (hereby known as “Course materials”). Shinjuku Japanese Language Institute permits each User to view and, in certain cases, download a copy of the course materials, provided that no modifications are made and that all copyright and other proprietary notices in the original Materials are retained. Not all content is downloadable, and availability depends on the course. Users are not permitted to alter, reproduce, share, or distribute the Materials and must keep them confidential. Any violation of these Terms and conditions will automatically result in the termination of your authorization to use our on-demand website.

7. User Affirmation

As a User, you affirm that you are legally authorized to make online purchases under your country's laws and regulations. You affirm that you are not an agent or employee of a competing language school or preparation company and that you will use the Site and Materials solely for your own educational purposes, not for reproducing or distributing Our School's content on other platforms, or for any other purpose. 

8. Disclaimer of Course Materials

The course materials provided on our on-demand website are provided "as is" without any guarantee. Our School does not guarantee the accuracy or completeness of the course materials on our on-demand website, and may make changes to the course materials, services, or prices described at any time without notice. The course materials may be outdated, and Our School assumes no commitment to update them.

9. Limitation of Liability

In no event shall Shinjuku Japanese Language Institute, its suppliers, or other third parties mentioned on this Site be liable for any damages (including, without limitation, damages resulting from a decline in results, service interruptions, or inaccurate information) arising from the use or inability to use our on-demand website or any linked site, or the course materials or information contained therein. If the use of the course materials or information on our on-demand website results in the need for service, repair, or correction of equipment or data, you assume all associated costs.

10. Governing Law

These Terms of Use are governed by the laws of Japan. Failure to comply with a provision of these Terms does not constitute a waiver of that provision. Our School reserves the right to assign its rights and obligations under these Terms without notice.

11. Effective Date and Updates

These Terms are effective as of November 6, 2024, and may be modified by Shinjuku Japanese Language Institute at any time without notice. Please review these terms periodically. Your continued use of this Site after such changes constitutes your acceptance of the new terms.
